1. Acceptance of Terms
By accessing the Cargo Delivery Express website and utilizing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms apply to all shipments, services, and transactions arranged through CDE.
2. Service Description
Cargo Delivery Express provides global logistics, freight forwarding, and courier services. We reserve the right to select the appropriate carrier, method, and route for transportation to ensure timely delivery, unless specifically instructed otherwise in writing.
3. Shipper's Obligations
The shipper warrants that:
- The goods are properly packed, marked, and labeled.
- The goods are not prohibited or restricted under applicable laws (e.g., hazardous materials, illegal substances).
- All documentation provided is accurate and complete.
4. Rates and Payments
Rates are subject to change based on fuel surcharges, currency fluctuations, and volume weight calculations. Payment must be made in full prior to the final release of the cargo unless a credit account has been established. Any customs duties, taxes, or penalties are the responsibility of the recipient.
5. Liability and Claims
Our liability is limited in accordance with international conventions (Warsaw Convention, Montreal Convention, or CMR). CDE is not liable for indirect or consequential losses (such as loss of profit). Claims for damage or loss must be filed in writing within 14 days of the delivery date.
6. Force Majeure
Cargo Delivery Express is not liable for delays or failure to perform caused by circumstances beyond our control, including but not limited to acts of God, war, strikes, weather conditions, or customs delays.
